On 5 January 2024, the European Commission published the 21st Adaptation to Technical Progress (ATP) to Regulation (EC) 1272/2008 on the classification, labelling, and packaging of substances and mixtures (the CLP Regulation). The new harmonized classifications concern, among others, cosmetic ingredients. Some of them have gotten CMR classifications, which means that the usage of these ingredients in cosmetic products will be soon affected. This regulation will apply from 1 September 2025.
Interestingly, 16 cosmetic ingredients (see below INCI names) got hazardous harmonized classifications, including two ingredients (i.e., Dimethyltolylamine and Trimethylbenzoyl Diphenylphosphine Oxide) that got a new CMR 1 classification, which ultimately threatens their use in cosmetic products.

Timeline
This ATP will enter into force on 25 January 2024. However, the new classifications will become effective on 1 September 2025. Note that suppliers may classify, label, and package substances and mixtures under the new classifications before the effective date. Regarding the cosmetic ingredients that have gotten harmonized CMR classification, the potential ban will apply from 1 September 2025 which means that no products containing these ingredients may be placed and made available on the EU market from that date.
